Frequently Asked Questions

What are my rights?

If you have been injured through the fault of someone else you could be entitled to money damages for pain and suffering, payment of your medical bills, wage losses, and permanent disabilities. The attorneys at Hellmuth & Johnson, PLLC work with your medical providers to determine the full extent of your injuries and to learn what medical treatment will be needed in the future. This is vital in order to ensure that you are fully compensated for your injuries. You should consult with a lawyer because each case is different and there are laws which determine when you must bring your case.

How do I know if I have a claim or a lawsuit?

Proving a medical malpractice or personal injury case requires a person to prove that another party acted negligently, thereby causing the person’s injury. The attorneys at Hellmuth & Johnson, PLLC, are experienced protecting those who have been harmed and can help you determine whether you have a case.

When should I talk to an attorney?

Because every case is different, you should have an experienced attorney review your case to determine the issues in your case. In addition, Minnesota establishes deadlines for bringing a lawsuit for your injuries. A person could lose their right to recover for their injuries just because of the passage of time. That’s why it is important to speak to someone experienced in representing people who have been injured.

If you are suddenly seriously injured by someone else, you can be sure the insurance companies have attorneys, investigators, and claims adjusters working to protect their interests. You, too, deserve to have that same protection, so it is not too soon to contact an attorney in order to protect your rights.

In addition, the attorneys at Hellmuth & Johnson, PLLC have worked with the medical community and are familiar with the medical providers that can help you recover from your injuries. We will work with you in finding the medical care you need.

How much will it cost to hire an attorney?

We handle most cases on a contingency basis. This means that we agree with our clients at the beginning of the case that attorneys’ fees will be based on a percentage of what we recover on behalf of our client. We don’t get paid on an hourly basis such as a family law attorney, so you don’t have to worry about receiving a bill for attorneys’ fees. If we are not able to make a recovery on behalf of our client, then we are owed nothing.

What type of compensation would I be entitled to if I file a lawsuit?

Again while every case is different, you could be entitled to payment of your medical expenses, both for medical treatment that you have had and if you need any medical treatment in the future. You could also be entitled to money for pain and suffering. If you are unable to work, you may be entitled to lost wages or a payment of future wage loss benefits.

If your claim involves the death of a family member, you could also be entitled to compensation for the loss of the relationship of your loved one and if your loved one or family member helped to financially support you, you could be entitled to additional compensation.
